Burgess Senior Crown Attorney Re: Official Request for Disclosure Re: Failure to Provide Disclosure Dear Senior Crown Attorney; Thank you for forwarding a small portion of the disclosure information I requested. We received and signed for it on Friday morning January 6, 2006. It contained only Officer Moore’s and Mr. Young's fabricated stories. Is it your contention that Mr Young was living here before I purchased my house? First I must correct the stories, then prove they are lies? This fabracation of evidence should tell you enough. So just a friendly heads up, when I checked the brightness of the moon, a random fact. I found errors. 2% brightness on a cloudy night, with no security lite and Mr Young can state as facts...Yikes! He has good eyes but gets other things mixed up eh? That's the only free correction you will get, after all you are trying to send me to prison for 12 years. I will now spend 100 hours going over their stories finding other holes. Just for the record, if I want someone arrested, all I have to do is make up stories, that don't even add up and Officer Moore will come to their home and haul them away, even if they are sick in bed? Yikes! That's just plain silly correct sir? So I will need the real or other evidence. Ok well thank you for sending that stuff, it amounts to about 15% of my request. Surely in a democracy you would have to have more than that to destroy a person's life. And that's the disclosure I am after, need and therefore must have asap. Justice delayed is justiced denied. Not only must justice be done, it must be seen as being done. You do not want to appear to be an obstructionist. What has not been supplied but is a crucial necessity of justice and needs to be forwarded expeditiously are the other items I requested on my behalf to defend myself against this unjust, and I feel, malicious and retaliatory arrest by Officer Moore. Please forward as soon as possible the following as they will be required by the time of my appearance on January 24, 2005 at 8:30 AM at the Bancroft Courthouse. * paragraph 3, fax dated November 29, 2005: The disclosure I immediately require is all occurrence reports. * paragraph 6, fax dated November 29, 2006 I also need are the notes for all the officers involved. And there has been quite a parade of OPP officers investigating the vandalism, threats and damages done against my wife and me. * paragraph 8, fax dated November 29, 2005 (Since no videotapes, audiotapes and other forms of evidence against me were forwarded I need you to confirm that there are in fact none to substantiate charges against me other than Mr. Young’s disclosure statement/stories after the fact.) * paragraph 6, fax dated December 5, 2005 I require all the notes of all the OPP Officers * paragragh 7, fax dated December 5, 2005 I will require disclosure of a tape recording of all radio transmission dispatches and personal communications involved with this incident I only need the radio transmissions pertaining to or relating to the Bancroft OPP. Again if this is unreasonable, in your view the two hours before the time and date of the alleged offence and one hour after the alleged will be fine. * paragraph 8, fax dated December 5, 2005 My defense will require the video tape (s) from the booking area and jail cell at the OPP station in Bancroft. I would like to have the roster of OPP officers on duty at this time and a record of who was actually in the police station at the time. * paragraph 4, fax dated December 12, 2005 (Please confirm which officers will be attending at court involving my case on January 24, 2006) I would also ask for your assistance to compel a few police officers to attend court, to give evidence or statements. * paragraph 5, fax dated December 12, 2005 On or about August 29, 2005. My lovely spouse and I had to make a 911-call. The lady was very kind and calmed us down, so it was a rather long call. She asked if we had ever made a 911 call regarding Mr. Young before, we had not. What I would like is a tape recording of this call. * paragraph 5, fax dated December 12, 2005 Occurrence report and police notes of police lady who attended with Officer Moore on or about August 18, 2005. * paragraphs 9 & 10, fax dated December 12, 2005 Officer Mihell’s notes and occurrence reports involving this incident. * paragraph 12, fax dated December 12, 2005 Officer’s notes if she has them * paragraph 13, fax dated December 12, 2005 Police lady Sue Cox attended our home; we explained the situation Mr. Young had carried out his threat to break the light. She made notes. Can I please have those? * paragraph 15 and 16, fax dated December 12, 2005 I will need the notes from the 4 police officers. Also please include the occurrence report. * paragraph 17 & 18, fax dated December 12, 2005 On Nov ---- Officer Allyson talked to Noel via phone, upsetting her saying I will be charged if we didn't meet Mr. Young and his wife for mediation. I can send you the fax i sent her, but i what her to also send it to you my reason is simple, if you wish it can help you facilated justice, that is you goal as a well paid civil servant is it not? Do you know how many logs i must haul out of the bush to earn 114,000 a year? You are a lucky man. Good for you! Can I please have the notes from that occurrence? Also any faxes or emails Allyson received? As you can see there are gaping holes in what I asked for regarding full disclosure and what I have received to date. Please provide me with the full disclosure I requested or give adequate reasons why I cannot have this information that is crucial to my case. For the record I have been and will continue to be co-operative and non-obstructionist. Please do the same. I am also notifying you that I anticipate taking this to trial in which case a minimum of two court days will be required to present my case. If this is not feasible with the Bancroft court schedule than I will be requesting it be moved to the Belleville court district. Burgess Senior Crown Attorney Re: Incomplete Disclosure Packet Dear Crown; Good monday morning; I do think I understand your letter. I know you have a job to do. As I have business's and an organization to run. In fairness to your office, you are correct in your letter. However, I still need the notes of the other officers. Please do your best to get them now. It takes only seconds to photocopy. Also Officer Moore has only turned in notes from the November 4, 2005 yet he cites other times he attended. Where are those notes. Can we have them please ASAP. One question, Mr Young's notes/stories, are you, he or his advocate Officer Moore going to be adding any more dates to them? I'm on his thrid story and only the first has a date, though he is off by about 365 days. Also of great importance to justice is the arrest report. Has Officer Moore not filed an arrest report? Why? The occurance report is a joke right? Is that how all occurrence reports are done now? I am surprised there is so little information and it is not in a standard form. Is this normal for the OPP? Please advise immediately. It appears from your incomplete disclosure package Officer Moore is suffering from confusion. He has gotten the dates and times mixed up. Perhaps that is why we have not received the notes from the other Officers. It also appears that Officer Moore is trying to mislead our fine courts. The missing notes and evidence such as the 911 tape will clear this up. A quick listen to the 911 tape will confirm this. I am from the private sector, where a dollar is very hard to come by. A penny saved is a penny earned. The florscent light bulb Mr Young broke and assaulted me with cost about 12 dollars. The gas to travel to Canadian Tire and back is about 10.00. Mr. Young continually called me Jew Boy. Stereo-typically calling me cheap in other words. My wife says I am frugal. Officer Moore is also very confused about dates.. Even if I would have walked away from the assault charge against Mr Young, there is no possible way I would accept .25 on the dollar. That may happen in the public sector but in the private sector we can't operate with such losses. I need the 911 tape. We all need the 911 tape. I need the notes from all the officers. I need Officer Moore's other notes. Does Officer Moore have two sets of notes? There have been 8 different police officers involved in this very sad display of Canadian justice, we must have their all their notes now, please. I would be on the record as also saying your duty was done and finished in craftsmen like fashion once I receive those. We have had a partial break through! We have now narrowed down who that tall smoking police officer was to two possible officers. It only took 2 months and 5 or 6 faxes. We need the notes from Officer Allan and Officer Hattin. Is Officer Hatten the police lady or Officer Allen the police lady, do you know? I am now politely demanding that all officers involved be subpoenaed to attend court. Are you going to object to me recording my trial? It's in the best interest of justice. Please make an effort to get the other 85% of available disclosure. At least try sir. And finally and most importantly, we still have not been informed what charges were laid against Mr. Young by Officer Dickson. As you can see from the disclosures on our website: http://thevandalnextdoordeaththreatsandmore.asar-intl.com that Officer Dickson received a significant amount of statements and evidence (audios, photos etc) of the death threats, property damages, criminal trespass at night to commit vandalism with which to lay charges prior to my refusal to mediate with a person who has harassed me and escalated his criminal behaviors over a period of months. What charges were laid against Mr. Young and which parts of the evidence does each charge apply to. We have a right to be informed and to date all we have gotten is assurances from the OPP Staff Sergeant Detachment Commander Freeburn that either Officer Moore or Officer Dickson will get in touch with me.
