We decided that perhaps it would be best for us to follow through by attending court in the hopes that we could drop off a letter for the Honorable Judge Hunter at the Bancroft Court if he was presiding or give it to his Court Clerk in his absence. On May 9, 2006 we arrived at the Bancroft Courthouse with a request that the OPP were either unable or unwilling to provide for our safety. (See letter below) Time and time again since August 2005 we have attempted to seek relief from the ongoing criminal escalations of Mr. Young only to have our pleas to fall on deaf ears. We felt it was important for our safety that Judge Hunter be appraised of those escalations and how they would surely effect our safety and wellbeing. Where the responsibility lays for this ongoing, bazaar and appalling circumstance is beyond our comprehension. Is it with a particular police officer or also with the officer and Barry Freeburn who should have supervised him closer? Is it with the Crown Attorney's Office who, to say the very least, so obviously failed in their screening process right from the beginning? The Crown Attorney for the Bancroft Court, Elaine DeLuzia, who right from the start said "no one is going to jail" minimizing the injustices done to us. Then maliciously refused to give full disclosure for our case or the charge screening sheet? Maybe it is all. Certainly justice in Ontario is broken. Certainly Ontario Justice has abandoned survivors and singled out us as fodder for the courts. During a recess of the May 9, 2006 court we asked the Court Clerk if she would be able to see that Judge Hunter receive a letter from us since he did not preside over the Court that day. As we began to discuss this with her, the Bailiff, stated loudly "Wait until your next court date." My wife, Noel said to him "We could be dead by then". She continued and added "Mr. Young has continually violated his conditions of release, he is escalating and is still doing damage to us and threatening us, he is throwing rocks at us. No one is willing or able to stop his escalations and something serious is going to happen." She stated that we know that if the police do not arrest him we can file papers before a Justice of the Peace in Bancroft but there is no guarantee that the Justice will carry through once those papers were filed. We stated that we wanted Judge Hunter to be informed that we were in danger. Both my wife and I were aghast that the Bailiff responded in a very unprofessional and loud manner "THEN GET A LAWYER". The Crown Attorney Elaine DeLuzia said little but as the Duty Counsel came from the back room it was suggested that he speak with us. We found the discussion unproductive as the Duty Counsel suggested we "go to the Media or contact our MP representative." We left the Court shortly after to consider what other options we might have. The following is the letter we wanted to have delivered to Judge Hunter: PO Box Bancroft ON K0L 1C0 Phone/fax: Email: andyefremov@asarian-intl.org May 9, 2006 Bancroft District Court Dear Honorable Mr Justice Hunter Bancroft, Ontario K0L 1C0 Dear Honorable Mr Justice Hunter; I need to call to your attention that circumstances have become unbearable regarding the situation and criminal behaviors against me by Mr. Timothy Young. Mr. Young has continued threatening my wife and I since January of 2006 despite his conditions of release. He is escalating daily and we feel he is out of control, the Bancroft OPP is either unable or unwilling to protect us or our property and despite numerous faxes and submissions of video and audio tapes of Mr. Young criminal acts (and these videos and audios are a much, much higher quality that those seen during our current trial) no one will stop him. We have exhausted every avenue that we can think of for justice to be served. We came to court today in hopes of finally having charges laid against Mr. Young for these new charges and violations. We understand that if the police are refusing to press charges and do their job than we can file charges ourselves. If we do that through the Justice of the Peace there is no guarantee that any papers will be served against Mr. Young. This is intolerable and we are very frightened that Mr. Young who is rapidly escalating his behaviors, and one by one is carrying through with verbal threats he makes will seriously injure us or kill one of us. He has said more recently that he will beat me until I'm brain dead. Do the police have to wait until that occurs to carry through with making this man accountable for his actions? I have enclosed the material I have informed and given to the police that the whole Detachment is ignoring from the Officers, to the apparent 'investigating' Officer, to the head of the Detachment Sgt Freeburn. Can you, as a Honorable Officer of the Courts order this man to be held accountable and stop him from further retaliations against us?
