Re: Second Request for Disclosure.

Dear Senior Crown;

Good Monday morning!

As per earlier correspondence, I am contacting you in order to obtain disclosure. I would like to state for the record, I am in fact compos mentis. Noel has purchased me (with funds raised on eBay) a legal term book.

The disclosure I will be adding to the earlier request is as follows. A brief explanation is added to assist you to expedite justice should you wish to. I am requesting that you do, justice delayed is justice denied.

I am also taking an extraordinary step disclosing my partial defence for the charge of putting up a motion detector security light, erroneously called a spot light in the official arrest papers. If you check our website the picture of Mr. Young's gas cans contains a picture of a "spotlight" he used to shine at our house in his response to our motion detector light. (http://thevandalnextdoordeaththreatsandmore.asar-intl.com/gallery/album08/threat2) I know it's a matter of semantics, but I strive to be correct. One point of fact to go with this. The spotlight that Mr. Young may or may not have been charged with installing is a malicious or offensive use of photons. I did nothing to his property. The motion detector security light I was forced to install (being a reasonable man) was solely defensive as a result of specific acts of vandalism and criminal trespass on my property by Mr. Young. Even though this is the case, I don't feel it's in the best interest of justice charging Mr. Young or i with this crime. I felt that Mr. Young's unremitting spotlight shining at our living room and bedrooms all night was easily rectified by my wife closing the drapes. Further it was totally eliminated, by closing our eyes when we tried to go to sleep.

I must presume that because of the actions (reckless disregard) of Officer Moore. Such as charging me for criminal mischief as a result of me installing the motion detector security light that shines for 10 minutes after activated by motions of Mr. Young throwing rocks at my house from his windows or when he commits criminal trespass to do vandalism on my property, you must now be proceeding by indictment. I would, however, like to have this confirmed by you asap, please.

Because this is a very serious charge I'm taking it as such. I require all the notes of all the OPP Officers on duty the day this alleged offence occurred. If you feel this is unreasonable, I do understand, we all know what we ask for and what we get are rarely the same. Just the notes of the officers involved in this alleged offence will be fine at this time.

Further as I have no clue what I did to merit the charge of criminal harassment - threatening conduct alleged. I therefore will require disclosure of a tape recording of all radio transmission dispatches and personal communications involved with this incident. I do not recall the police coming to our house with these allegations and I'm sure Mr. Young would have immediately called the police to investigate such charges, just as we had requested the police to attend the incidents that occurred to our property and us. My ongoing research indicates the Bancroft OPP is directed from the Bellville OPP station. I only need the radio transmissions pertaining to or relating to the Bancroft OPP. Again if this is unreasonable, in your view the two hours before the time and date of the alleged offence and one hour after the alleged will be fine.

I'm taking another extraordinary step, in the pursuit of justice, including statements from my lovely partner and myself on the night of the unfortunate very public arrest at 9:15 pm. I'm doing this because part of my defence will require the video tape (s) from the booking area and jail cell at the OPP station in Bancroft. Feel free to instruct the RCMP to seize it if that is required. I do not want it deleted by the time you ask for it. I would like to have the roster of OPP officers on duty at this time and a record of who was actually in the police station at the time.

The dates pertaining to this request are as follows.
The arrest was Friday November 25, 2005
The mischief charge is listed as November 1, 2005
The criminal harassment - threatening conduct is listed as October 11, 2005
That is all for now.



In the interest of justice, it was told to us before this matter became extremely serious that we did not need the police to file charges against Mr. Young and we could file charges on our own. If that is still the case, we would chose to go that route for the following reasons:

1. Officer Dickson has admitted to a section 8 charter violation of rights and freedoms occuring the day after the attempted arson.

2. Officer Moore and Officer Dickson were both browe beating us into mediation using the threat of arrest were my wife or I not to participate.

3. When I would not participate in mediation with Mr. Young, Officer Dickson became very anger raising his voice that he did not need me anymore. Officer Dickson had received from us our CD with evidence (videotapes, pictures, audio tapes and our previous statements/fax copies) which he assured us was sufficient enough to lay a number of criminal charges against Mr. Young.

4. Due to the previous occurances we are very concerned that having spent a great deal of time and money to gather the appropriate evidence and protect our property and safety, that Officer Dickson will not show up in court.

5. If it is necessary for us to go to an outside police agency such as the RCMP or hire an attorney to prosecute this case, we will find away to.

Statement November 26, 2005 - Noel

On the evening of Nov 25, 2005, at approx 9:15 PM OPP Officer More arrived alone and had entered our home at 53 Sprucedale Ave in the town of Cardiff, Ontario. He asked to speak with my spouse and partner, Andy Efremov. I told him to wait a second as Andy was laying down and had a migraine and had taken some sleeping pills. Officer More said he had to speak with Andy and I should get him.

When Andy got up Officer Moore said he was here to arrest Andy and lay charges. I asked what the charges were. He said he was arresting Andy for criminal mischief and uttering threats. He said that Officer Dickson has laid charges against Mr. Young on our behalf earlier in the day. I directed him to the living room where we could sit down. I asked what criminal mischief and what threats was Andy being charged with? I asked if Andy was being arrested for putting up a security light? He said Mr. Young said Andy did things and threatened him and his wife. I said how can Andy be arrested on just Mr. Young's word, with no evidence and we had to go through so much for months to get the evidence of Mr. Young's vandalism, criminal trespass and threats? We have proof and he can just says anything? He said there was no mediation. He looked annoyed so I didn't ask any more questions.

He read something official sounding. We were advised that Andy would be transported to the Bancroft police station to be charged. Andy said he was ill with a migraine and had taken sleeping pills so he was groggy. Officer More made it clear that Andy had no choice. Andy got his boots on, said "ok lets go" Officer More advised Andy to get a jacket, which Andy did. Officer More asked Andy if he had any weapons, guns or bows. Andy said he had a broken crossbow. We were told to surrender it. He also asked if we had any bolts. Andy said, you mean arrows? Officer More said yes. Andy looked for them and then told Officer More they may be on our land at North Bapiste Lake Road. Officer Moore said that's ok just get the crossbow. When Andy went to get the crossbow I remembered that I have a bow also so I asked Officer More if he needed that too. He said yes, any bows. I said I don't have any arrows for it. I went to get it and gave it to him. When I gave it to him he commented that it was a really nice bow and asked if I did competition and was I a marksmen. I said no, I don't know how to use it but had been hoping to eventually practice but haven't gotten much chance to learn. I asked if we get it back.

Andy gave Officer More his crossbow. He said that he had to read Andy his rights. He read him something in the dining room. Andy said he needed to go into the bathroom and take some aspirin because his migraine was getting worse. He went inside took some aspirin and came back into the dining room. When Officer More said they had to go, I asked if I should go to pick Andy up at the OPP station. Officer More said it would take about 45 minutes or an hour and I could pick him up then. Andy put his hands out front for Officer More to handcuff him and Officer More said he didn't have to. As they walked through the kitchen to the side door to leave Officer More asked where the string to the crossbow was or why the crossbow didn't have a string, I forget which. We said it's broken and doesn't have one. I then remembered that I needed the keys to the car because the key to the garage was on it. We lock it up because of damages to our car by Mr. Young. I asked them to wait because I had to make sure I could find them so I could pick Andy up. They waited for a few minutes until I located them. Officer More said that he would call when I could pick Andy up. They left. I saw Andy get into the cruiser and put his head down. I think he felt ashamed that they arrested him. I felt sorry for him. Here we had done everything to help get the police the evidence so they could put a stop to what Mr. Young has been doing to us for months and Officer More can just arrest Andy on hearsay and innuendo. I locked the doors and felt scared and confused. Why would they take Andy and leave me alone when I had told them the night of the fire that Mr. Young had again said that he would get me alone and kill me when no one was around. Now I had to go outside with no one around at night. I didn't want to go outside but I didn't want to stay in the house alone either. I wished I had thought to just follow them when they had left. I decided to go to the police station right away and sit outside in the car. I got dressed (I had been in my robe because I had been ready to go to bed). I decided to take Spike, my dog with me because I was afraid to go outside by myself. (He's a big baby but he looks big and he adores the ground I walk on) I got the side garage door unlocked and went inside to open the garage door to get the car out. When I opened the garage door I saw Mr. Young was outside by his car and he began to walk toward the garage door. He didn't say anything but was just glaring at me. I turned around and called Spike into the car and got in and locked the car doors. I backed the car out and I didn't see Mr. Young there anymore. I drove to the OPP Police Station and waited outside for Andy to come out. I saw Officer More open the door and Andy coming out. I got out of the car and called to Officer More to wait because I wanted him to know that Mr. Young was waiting for me. As I started to say something, Andy said don't bother, they don't care. We drove home.

Re: Statement of arrest- Andy

On the evening of November 25, 2005 OPP Officer Moore arrived alone and had entered our home at 53 Sprucedale Ave in the town of Cardiff, Ontario and arrested me. He stated that since I refused mediation with Mr. Young he had to arrest me. (I did not feel that mediation with Mr. Young was in my or my wife's best interest for safety reasons or legally in my best interest because charges were pending again Mr. Young for criminal trespass, vandalism and continual death threats.) I tried to explain to Officer Moore I was ill and had taken sleeping pills; I asked could we please to this tomorrow. Officer Moore raised his voice, saying no you are going now. I got my boots on and presented my hands, hoping he would hand cuff me with my hands in front, instead of behind my back. I had been knocked to the ground in a logging mishap a while ago; I'm still sore on the right side. I presented my hand this way when I presented myself for arrest at the police station the 6 days earlier knowing that I would not be doing mediation with Mr. Young. He then asked if I had a gun or a bow. I said yes I have a cross bow but it does not work. He said get it. I did. Noel got her long bow. He wanted the arrows or as he said bolts which we did not have here. He asked where the drawstring was. I said it doesn't have one. Officer Moore then took them outside. I went into the bathroom to take some Tylenol 1's. I heard Noel ask if we would be getting them back, Officer Moore said yes (I take that to be a promise).

I was co operative even gesturing to open the police car door. I wanted to get going, it is bad for business being arrested. Officer Moore then turned on the inside car light, I covered my eyes. Light hurts my eyes when I'm in pain with a bad headache. We sat in the driveway for what seemed like an eternity. In shame (unwarranted) I crossed my arms and lowered my head. I stayed this way most of the night, unless Officer Moore ordered otherwise. (See video footage from the two incarcerations at the police station) Officer Moore asked me if I wanted a lawyer. I clearly said no. Officer Moore raised his voice. Said I asked you if you wanted a lawyer?? I said NO THANK YOU. A lawyer that helped me once before told me what to do if I was ever arrested. (Sign the papers, be polite and keep my mouth shut.)

Officer Moore quickly arrived at the police station. He ordered me to follow him. We entered a painted cinder-block room. He ordered me to remove my boots, coat and empty my pockets; I did just that. I had no cash, only two Tylenol #1's and some chapstick. Officer Moore then asked me again if I wanted to call a lawyer, I said no. He ordered me into the cage. I entered and sat on the floor, sitting in a manner to shield my eyes from the bright lights. Later he returned, to take pictures of me. He then fingered printed me. Told me to wash my hands. I did, I then cleaned the sink counter where cleaning fluid and water spilled. I stepped back. He then stated that I had to be printed again, for the RCMP. I submitted again washed up and cleaned the counter again. He then ordered me back into the cage. I sat in the same place in the same protective manner. Officer Moore again left. Later he returned and released me from the jail cell.

I was ordered to sign papers. I glanced at them and did as I was told.

Officer Moore gave me conditions for my release. He stated that if I even wave at Mr. Young I would be locked up. As Officer Moore knows, I was raped over a two year period when I was 12, being locked in a cage with men who don't respect the laws of our land scared the hell out of me, hence I will not break laws. (This is a point of great fear and ongoing worry and stress for my lovely spouse and myself) I'm going to show some of my cards to the Crown so that this point can be cleared up. Mr Young has publicly insinuated that I broke into his home and stole his hero's of the Third Reich stamp collection. Honest I didn't and would never do such a thing for several reasons. I would like Judge Hunter, to tell me, Andy even though a provincial court judge made your little survivor organization possible, and even though you have done everything you said you would do (so far), a neo-Nazi who calls you fag and Jew boy and was selling drugs to kids has more credibility than you. I'm merely a victim of childhood abuse that has dedicated his life to stopping the ongoing tragedy. I don't feel that is reasonable in our great country. I'm afraid to leave my home, because as it stands Mr. Young simply can say Andy waved at me, and Officer Moore will respond by locking me up! I must spend hundreds of dollars in equipment and lose thousands of dollars in lost wages and then wait weeks after providing proof of Mr. young's crimes - only to be arrested and charged with an indictable offence. The police tell me get a video camera and spotlight. Then they arrest me for installing that light because Mr. Young complains that it bothers him because he can't vandalize my property under the cover of darkness. It's blind luck that I did not install a camera as some of the officers attending to our house had suggested. Officer Dickson or Moore (the story changed) conducted an illegal search the day after the attempted arson looking for a video camera. I had closed the garage doors the night of the attempted arson and my wife found the larger garage door half open the next morning when we went outside. I feel because of this that there is collusion between Officers Moore and Dickson and Mr. Young. My wife had asked Officer Dickson when he phoned a day or two later if Mr. Young or the police had been in our garage the day after the incident. He told her it was Officer Moore and he thought it occurred that night. My wife and I both know that is not the case and we had secured the garage. Officer Dickson has unclean hands.

Officer Moore has advised me to move, my wife and I were truly shocked as we failed to note the foreseeability of Mr Youngs actions. Now I'm just hoping to leave Ontario with my life and wife. I have put the house on the market, the real estate agent said get a small loan and fix it up. I was in the process of refinancing so I could do that. Now because of charges I would have to lie on the loan application, I will not break the law. I will have to lose about $20,000 to get out of this town where my neighbour, Mr. Young, has continually harassed me. I pay my bills, the bank will help. I need to deal with this situation now. Noel's birthday is on Xmas I can't even share a bottle of our homemade chokecherry wine with her, let alone buy her the gifts she derserves for helping Survivors.

Please help speed up the wheels of justice, before we get crushed by them.
