Re. Third request for disclosure.

Dear Senior Crown;

Att. Joyce; Good morning Joyce;

First thank you for your call on this past Wednesday, I do appreciate very much your attention.

This letter is my third request for disclosure. What I would respectfully request today are the following items. I will try to add an explanation as well as provide as much information as possible to aid you.

I would also ask for your assistance to compel a few police officers to attend court, to give evidence or statements.

On or about August 29, 2005. My lovely spouse and I had to make a 911-call. The lady was very kind and calmed us down, so it was a rather long call. She asked if we had ever made a 911 call regarding Mr. Young before, we had not. What I would like is a tape recording of this call. A tape would be best. However if you feel, or the folks down at the 911-call center, cannot provide this for us a transcript would be all right. I think one of the Officers that responded was Officer Moore, I'm not sure though. If it was, my research indicates it would become important. I will also need the police report/occurrence report from this emergency call and subsequent responses.

Previous to this Mr. Young had phoned the police on his behave. On or about August 18, 2005. I was expanding my sawmill for an upcoming job. I was working late, perhaps around 9:30 PM because it had just gotten dark when the police arrived. I had power tools but because I do respect the right to live in peace and quiet was using only hand tools. I was trying to be as quiet as possible. Mr. Young was slamming his door and leaving his house. I was not paying any attention to him at first. After awhile I looked up at Mr. Young, and was surprised to see a police lady on one side of my car and a policeman on the other side walking towards me. They informed that Mr. Young was complaining about the noise. I stated what I just said to you. The Police lady told me "10:00 PM shut it down." I said I would now put away my tools and go inside my house, further I said in the future I would "shut it down before 10:00 PM making the hand gestures the baseball umpire makes when a player is safe." Mr. Young left his home and told the police officers that he wanted to see them before they left. The police lady just stared at him and he went inside, perhaps she felt this was not a reasonable use of police time. The mill was never running, I was only bolting on an extension quietly not even using a power tool so I could mill logs 17 feet long, instead of only 12 feet. I didn't tell Noel the police had attended, I didn't wish to trouble her. Later she asked why were the police here? I explained. I also asked her to be cautious of the time when I was working outside, that at 9:30 PM regardless of the task I was trying to accomplish she must come out and tell me I have 1/2 hour to clean up and shut it down. This she continues to do. I would like the information generated from this occurrence.

When Mr. Young started throwing rocks at us, a few people just didn't believe this. It does sound childish but Mr. Young does in fact do this and in fact has a bucket he fills and takes inside with him to throw out his windows and door. To prove my allegation I had to carry a camera with me when I was barbecuing, working or any other activity a homeowner would do, the stuff every one else takes for granted. During this time I tried to photograph Mr. Young in action. I also cautioned Mr. Young that if he continued to make death threats to my lovely wife, his picture would appear on a section of a website. At that time Mr. Young stated he and his buddies were making "pages, lots of pages about me." After Mr. Young was photographed he stormed out of this home and pelted my dog and me with a handful of rocks; I did in fact suffer an eye injury as a result of my evidence-gathering attempt. I will bring the pictures to court or email them to you if you ask.

Anyway, two days later at about 9:00 PM two police officers arrived at my home. Noel invited them in. I think it was Officer Moore and Officer Mihell. They stated Mr. Young had called them saying I photographed his daughter. A ludicrous assertion. They asked to see my camera so I got it and handed it to Policeman Mihell. He said you show me, which I did. There were no pictures of his daughter, as I would never photo a young person. But I did suggest that taking pics from my own property was not a crime. One of the police officers then asked to search our computer, again I said help yourself. Again I was asked to show them, which I happily did. Officer Moore stayed with Noel in the dining room Policeman Mihell and I went into the office. I showed them some of our websites, some of our Survivor client's very nice sites and I showed them the same pictures they saw on the camera including one of Mr. Young's car plate which would have included my beloved dog had he not seen another lady dog and left. So much for loyal friend! This photo was to serve two purposes. When the pics of Mr. Young's window came up, policeman Mihell asked if I could lighten it so we could see if in fact if I was taking photos of Mr. Young's pregnant teen. I did enhance the photo and we could see Mr. Young peering out his window at me. Not a crime. I asked if his daughter was even home at the time, the police (not sure which one) said they did not know. Mr. Young's word is enough to send the police on a search! Is his word enough to obtain a search warrant? I am asking for a copy of a search warrant, if there was one issued. Also a copy of the occurrence report and the notes the officers must have made that night. I was told by Officer Mihell that they would inform Mr. Young that there were no pictures of his daughter. I would like the tape of Mr. Young's 911-call, unless he was able to call Officer Moore directly.

The following day my wife Noel went to the local store and was accosted by Mr. Young outside the store. She was quite upset that he had threatened her out on the street locally. Instead of coming home she went to the OPP station because she was afraid. While there she spoke with Officer Sue Cox. Noel said they had a nice conversation and she calmed down. She decided to not have Officer Cox talk to Mr. Young because she felt he might escalate more and maybe he would just calm down on his own. She said she knew that I would be angry if I found out that he had approached her outside the store and threatened her. Officer Cox asked if she had any idea why Mr. Young was doing these things lately and Noel told me she said the only thing she could think of was the previous fall we had words with Mr. Young about his dealing drugs to kids in the neighborhood but she had seen him get rid of the grow lights and stuff a few nights later. She told Officer Cox after that she didn't think he was still dealing drugs late this summer when his behavior first started escalating. Other than that she doesn't know what set him off.

On Halloween, we called the police (we had been told call right away when Mr. Young does damage) Policelady Sue Cox attended our home, we explained the situation Mr. Young had carried out his threat to break the light. She made notes.

On the night of the fire, 4 police attended. I did not call. I know that Officer Moore was here and Officer Dickson also. There was also a Policelady with dark hair ( I didn't get her name) and a different police officer that I don't know. He was tall, thin, older and smoked cigerettes; he looked like he was a supervisor. He was also at the station the Sunday I presented myself for arrest in lieu of mediation with Mr. Young. He conducted an investigation into my light installation.

On Nov ---- Officer Allyson talked to Noel via phone, upsetting her saying I will be charged if we didn't meet Mr. Young and his wife for mediation.

#3F) On or about Nov 4, 2005 I was summoned to police headquarters, where I presented myself for arrest. I felt it was not in my best interest to do mediation with a man that was continually threatening my life, that of my wife's and my pets. I presented myself for arrest since they had said if I didn't mediate with Mr. Young I would be arrested. Officer Dickson asked me if I wanted a lawyer; I said no. He then started to read my rights, however he stopped. He then got Officer Moore. Officer Moore was very nice, we talked a bit about the serious problems of child porn. He seemed to actually care about a cause that I do. He then cut an OPP patch off a part of his uniform, I told him not to. So did the tall thin smoking police officer. Let me be clear here at this point I thought we had a deal. A verbal contract, depending on my ability to get Noel to accept a letter of apology. The deal was this; Mr. Young cleans the eggs off the house, Mr. Young pays for his damages. Mr. Young writes an acceptable letter to Noel saying he was very sorry for threatening her. I spent many hours convincing her. She agreed but felt Mr. Young would nix the deal. Thursday night I got a call from a very unnecessarily upset Officer Dickson. The deal was now different, I had to meet with Mr. Young and write him a letter. I said I would not be writing him a letter nor would I meet with Mr. Young. That was not the deal. Here is the problem Mr. Young knows he broke the law, the letter would be a confession. The thing is I would not have used it against him. My last attempt was to agree to this forced mediation with the provision I could tape record this meeting. Officer Dickson said no.

If they say they failed to make notes, all notes from the day before, the day after and the day in question. If you feel this request is unreasonable the notes from the day in question will be fine, for now.

One last thing, I have heard that Judge Hunter is very busy. Can you please tell me what my responsibility would be to change the venue to Belleville? Can you do that? Must I? I'm not asking to help me to avoid justice, just speed it up.
