Night of 11/12 Aug 2005; Thursday

On the night of Aug 11 2005 Andy was upgrading the sawmill in preparation for a job the next morning. He was doing this quietly in the driveway by the garage using a hand wrench to tighten a few bolts and recalibrate the level of the machine. Mr. Young called the police complaining about excessive noise. Andy complied with the police request that he stop.

29 Aug 2005, Mon

In the late afternoon of August 28 Andy was playing with the dog in the backyard. Young began hollering out the window at Andy and Andy snapped a photo of Young and took several pictures of Young's car licence plate. (This had been in connection with a conversation Andy had with a member of project long arm and our concern with Young selling drugs to kids. Young apparently phoned police alleging Andy was taking pictures of Young's daughter.

30 Aug 2005; Tuesday

In the morning of Aug 30, 2006 Noel had gone to the local store to get some things. As she pulled in getting out of her car Mr. Young accosted her getting in her face scaring her and hollering about pictures of his daughter. She went to the police station and spoke with an OPP Officer at the Bancroft Detachment not knowing what she should do in response. When asked about history of problems with neighbour she stated she felt it was regarding Young selling drugs to kids a year ago. She made no formal complaint feeling that Mr. Young had been drinking heavily.

30 Aug 2005; Tuesday

Officer attended due to Mr. Young's complaint of Aug 29 2005 where Young felt that pictures of Young's daughter had been taken. Officer spoke with both parties. He requested to looked at both our computer & digital camera. Officer determined that in fact no photos of daughter were taken of the daughter. He determined that photos of Tim Young's license plate & T. Young had been taken as we had stated. Officer advised both parties to stay away from each other. From this point on neither my wife or I spoke with Tim Young despite continued and escalating criminal behaviors by Tim Young. At this time we determined that it would be wise to install a security light and camera.

1 Sept 2005; Thursday

On Sept 1 2005 Andy purchased a time activated security light from Canadian Tire and began to install it. Young began harassing Andy as he tried to install later breaking a trouble light and threatening Andy with it. As we phoned 911 Young also began rummaging through our Jimmy. Officer Moore minimized the assault leaving a $5 bill on our table to pay for the broken trouble light later stating we were 'pleased' with the results. Officer Moore later admitted under questioning that he erred during the writing of his occurance report.

Officer Dickson Occurrence Report: Attended due to Andy phone call regarding ongoing Dispute with neighbour requesting to speak with an officer. Received copies of letters regarding previous complaints with Young. Complaintant advised they were keeping notes, photos, & audios of dealings with neighbour. Suggested lid to deflect light.

I believe it was a few days later that we met with the newest investigating officer and we discussed the audio and videos that showed the more recent escalating criminal behaviors of Mr. Young toward us. I and my wife gave video statements at the Bancroft OPP Detachment. The items we presented as proof constituted approx 14 new charges and violations of Mr. Young's conditions of release. The Officer stated he would be delivering them to Mr. Burgess of the Crown Attorney's Office who said he could not make a decision to press charges until June 1, 2006. We are grateful to OPP Investigating Officer Vanderwoude for doing what he could. Had it been Mr. Burgess's wife and family who were being threatened we wonder if it would have taken him three weeks to decide regarding their safety.

May 19, 2006

On May 19, 2006 while waiting for Mr. Burgess to decide that conditions of release being violated by Mr. Young was worth of the ink on the paper they issued him back in November 2005, Mr. Young assaulted me in my driveway using his vehicle. While repairing a post he had damaged a few weeks earlier and using it to attempt to break the door light on my house (yes, remember he had left my garage roof smoldering back in November 2005 after using a broom handle to break the motion detector light), Mr. Young came home and backed his van into his side of the driveway. After threatening me he walked into his house. Waited a few moments and then came out getting into his van saying he's warned me so now it's my fault and proceeded to move his van forward and then back it up next to where I was stooped filling the fence post hole. He opened his van door purposely using his car door to strike me in the spine and then kicked me in my back knocking me to the ground.

Noel phoned the investigating officer who arrived on the scene and arrested Mr. Young. We provided the video tape of Mr. Young's assault to the investigating officer. Noel and I gave statements to the OPP of what had occurred. Mr. Young received further conditions which included he was not to contact us, could not come onto our property. He could not reside or come onto his property until our court date on June 20, 2006. This was in lieu of being held in jail until the court date.

I was disappointed that the response by the Commander of the OPP Bancroft Detachment Barry Freeburn felt it was appropriate to minimize Mr. Young's most recent assault by suggesting that he felt that I should be examined by a psychiatrist. I do not understand, is Officer Freeburn suggesting that mentally ill people are not entitled to protection under the Charter of Rights. It is my understanding that mentally ill Canadians and even regular survivors are afforded "enhanced" protection under the Charter of Rights, maybe I'm wrong. His response was that I lost credibility, my reply was that if I could regain credibility by seeing a psychiatrist I was amiable to that. Further I stated I had seen a psychiatrist before regarding what was done to me at Rosseau Lake School when I was 12 so I had no problem with that. We had about a 5 or 10 minute conversation which ended with him notifying me that he would be writing me a letter. As of yet I have not received any further correspondence from Officer Barry Freeburn. I would like to have him confirm or state the other content of our conversation. It was a very unusual chat and I would like him to confirm the content in writing. My wife was extremely curious as to whether this was a common practice by the administrator and Commander of the OPP in dealing with victim's of crime? She joked with me, kidding on the way home that given Mr. Young has been assaulting, threatening, vandalizing and harassing us almost daily for the last year that Commander Freeburn does have a point......we must indeed be mentally challenged because a normal person would have certainly retaliated after a year of this.

First week of 20 June 2006

During the first week in June 2006 we began to see Mr. Young slowly test his new conditions of release, first pulling up to his house and dropping someone off at the road. A day later pulling into his driveway, then backing into his driveway, then arriving once or twice a day. At first quietly and then making a bit more noise to announce his arrival. On June 9, 2006 we phoned the Bancroft OPP to let them know he was again violating his conditions of release. We provided video's. Mr. Young was again arrested and held overnight at the Bancroft OPP and then transported to the Belleville Courthouse for a bail hearing. Mr. Young was housed at a prison near Belleville and had attended court in front of a Justice of the Peace we believe on Friday June 9 and possibly Monday June 12 and finally Wednesday June 14, 2006.


9 June 2006

12 June 2006

The outcome? Mr. Young is out on bail on surety. He must reside in LaAmble with the person who signed surety of approx $1000 under house arrest. (He says he has a job to go to). He must stay in the house from 6PM until 6AM each day, check into the Bancroft OPP on Fridays. He cannot come into the town of Cardiff. He must attend Bancroft Court on the morning of June 20, 2006 to answer to the latest charges and he must attend Bancroft Court on the afternoon of June 20 as he is a witness our ongoing case. The following was the Statement for Denial of Bail from myself and Noel sent on June 12, 2006 as victims separately sent to the Crown Attorney's Office, The Presiding Justice of the Peace for the Bail Hearing, the Victim Advocate's Office and the Ministry of the Attorney General. (We do not know if the Crown Attorney's Office actually gave the Presiding Justice of the Peace a copy of what we addressed to him).
